The General Assembly Passed Protection in 2007
from the US Supreme Court's Kelo v. New London Ruling
This ruling allowed local government to take the
property of one person and give it to another, usually
a private developer or a retailer, such as Wal-Mart or
Target, whom they believe will put it to better use.

Governor Kaine signed strong anti Kelo Legislation this session
so Virginians are at least for now protected from this expanded
abuse of eminent domain.  Localities who benefit from the ruling
however are already preparing an assault on these protections.

Our property will not be safe from Kelo abuse until we have a
Constitutional Amendment

Be sure and read the Virginia Institute for Public Policy's
publication about other Eminent Domain abuse in Virginia

The Real Story of Eminent Domain in Virginia: The Rise, Fall, and
Undetermined Future of Private Property Rights in the Commonwealth.
The report details amazing abuses of Virginians’ property rights; exposes legislators
who have worked to stop every effort at eminent domain reform; and then
recommends what must be done to protect our property from abuse.

"the  people  have turned  to  their Legislatures to enact new laws. The goal is to make it
clear to  the   courts  and  to the regulators  that  if  it becomes  necessary to  use  private
property  for a public  purpose,  it is only fair  that  the  affected owners  not bear a greater
burden of the cost for doing so than anyone else.                        Toby Prince Brigham, Esq.
